Who Is Liable in an Alameda Uber Accident?
Liability generally falls on the negligent party who caused the accident resulting in the victim’s injuries. However, due to California’s Assembly Bill 5, Uber and Lyft are now required to list their drivers not as independent contractors, but as employees. - $50,000 in bodily injury liability coverage per person
- $100,000 in bodily injury liability coverage per accident
- $30,000 in property damage liability insurance
Furthermore, Uber maintains a driver’s insurance policy of $1,000,000 available in some cases.
How to Receive Compensation in an Uber Accident Case?
Generally, people injured in an Uber accident receive compensation by filing a personal injury claim with an insurance company. In an Uber accident where Uber or the Uber driver is liable, the victim can file a claim with:
- Uber’s insurance company
- The personal insurance policy of the Uber driver
Where you file your personal injury claim will depend on the time of the accident. Uber breaks down four main periods in which accidents can occur. The four different periods are:
Period 0 is in effect when Uber drivers have not logged into their Uber app and are not looking for customers. During this period, drivers are not technically commercial drivers. They’re driving for their own personal use. If a person is injured in an accident caused by an Uber driver during period 0, the party cannot file a claim under Uber’s company policy. Instead, the injured person will need to file a claim with the driver’s personal insurance policy.
Period 1 is in effect when the Uber driver is logged into their app but has not located or found a customer to transport. Once logged into their Uber app, drivers are operating their vehicles for commercial purposes. If there is an accident during this time, the injured person first files a claim with the at-fault driver’s policy and then with Uber’s insurer.
Periods 2 & 3
Period 2 is when a driver has accepted a customer but has not picked them up yet, and period 3 is when a customer is in the rideshare car. Period 3 starts from the moment of pick-up and ends at the drop-off moment. During these periods, Uber provides liability coverage of $1 million. However, the coverage only applies after an injured person files a claim with the Uber driver’s own insurance. If the driver’s personal insurance policy does not cover or cover the total damages, the injured person can file a claim with Uber.
