Alameda Uber Accident Lawyer

Ridesharing services such as Uber and Lyft are convenient and economical ways for people to get around. Ridesharing technology makes it possible to quickly and efficiently connect with a driver through an app on your phone. The convenience the app offers has made it increasingly popular. While the app is easy to use, Uber drivers and others on the road are still humans who can make mistakes. Rideshare drivers can and do get into accidents that have devastating consequences.

You may be unsure about how to proceed to recover compensation for any injuries you sustained after an Uber accident. An Alameda Uber accident lawyer can help you determine the best course of action so you can recover the compensation you deserve.

Most Common Causes for Uber Accidents in Alameda

Rideshare drivers are not immune from getting into accidents. The most common causes of Uber accidents are:

Distracted Driving

Rideshare drivers have numerous different sources of distraction, including noisy passengers, app notifications, calls, and even their GPS notifications. Drivers need to be focused on the road to stay alert and aware of their surroundings. The split second the rideshare driver takes to check the GPS or is distracted by a rider can lead to a collision that may have otherwise been preventable.

Driving Fatigue

Rideshare drivers make money depending on how many riders they transport, which can lead to drivers working longer hours than they should. Rideshare drivers often work late into the night as a second or even third job to help manage their expenses. If they begin to drift or fall asleep at the wheel, they put themselves, their passengers, and others on the road in danger.

Speeding

As mentioned above, the goal for rideshare drivers is to transport as many riders as possible, meaning they are likely to hurry to pick up passengers and get them to their destinations as soon as possible. The quicker they pick up and drop off passengers, the more they earn. However, despite common knowledge that speeding is one of the leading causes of accidents, drivers will still do it to meet demand and earn money. There are also other drivers on the road who may be speeding and collide with your rideshare car.

Tailgating

Following too closely behind another motorist is a dangerous behavior that is far too common, particularly during heavy traffic. Drivers who are tailgating may not have enough space to respond in time to avoid a collision with the vehicle ahead of them.

Impaired Driving

Drivers under the influence of alcohol or drugs have significantly impaired reaction times and driving ability.

Your rideshare driver may be doing everything to safely get you to your destination. However, they are human and cannot account for everything.

Who Is Liable in an Alameda Uber Accident?

Liability generally falls on the negligent party who caused the accident resulting in the victim’s injuries. Therefore, liability may fall on the Uber or Lyft driver or other motor vehicle drivers involved in the collision. However, due to California’s Assembly Bill 5, Uber and Lyft are now required to list their drivers not as independent contractors, but as employees. With this new classification, people injured in rideshare accidents can also hold Uber or Lyft liable for damages in a personal injury case.

It’s important to know what insurance coverage is available to victims who wish to hold Uber or Lyft responsible. The minimum liability insurance coverage for non-rideshare drivers is $15,000/$30,000 in bodily injury liability per person or accident, and $5,000 for property damage. Uber drivers are required to carry a personal auto insurance policy that covers:

  • $50,000 in bodily injury liability coverage per person
  • $100,000 in bodily injury liability coverage per accident
  • $30,000 in property damage liability insurance

Furthermore, Uber maintains a driver’s insurance policy of $1,000,000 available in some cases.

How to Receive Compensation in an Uber Accident Case?

Generally, people injured in an Uber accident receive compensation by filing a personal injury claim with an insurance company. In an Uber accident where Uber or the Uber driver is liable, the victim can file a claim with:

  • Uber’s insurance company
  • The personal insurance policy of the Uber driver

Where you file your personal injury claim will depend on the time of the accident. Uber breaks down four main periods in which accidents can occur. The four different periods are:

Period 0

Period 0 is in effect when Uber drivers have not logged into their Uber app and are not looking for customers. During this period, drivers are not technically commercial drivers. They’re driving for their own personal use. If a person is injured in an accident caused by an Uber driver during period 0, the party cannot file a claim under Uber’s company policy. Instead, the injured person will need to file a claim with the driver’s personal insurance policy.

Period 1

Period 1 is in effect when the Uber driver is logged into their app but has not located or found a customer to transport. Once logged into their Uber app, drivers are operating their vehicles for commercial purposes. If there is an accident during this time, the injured person first files a claim with the at-fault driver’s policy and then with Uber’s insurer.

Periods 2 & 3

Period 2 is when a driver has accepted a customer but has not picked them up yet, and period 3 is when a customer is in the rideshare car. Period 3 starts from the moment of pick-up and ends at the drop-off moment. During these periods, Uber provides liability coverage of $1 million. However, the coverage only applies after an injured person files a claim with the Uber driver’s own insurance. If the driver’s personal insurance policy does not cover or cover the total damages, the injured person can file a claim with Uber.

I was seriously injured in a motorcycle accident. Bill Karns was with me every step of the way. Even though the other driver said the accident was my fault, I recovered over $1,300,000.00. Mr. Karns was professional, courteous, and skilled. I would recommend him and Karns & Karns to anyone involved in a major personal injury case.

After a horrible incident and life-changing event, Mike and Bill brought hope back into my life.

Mona L.

I was traumatically injured on the job by a negligent forklift driver. I reached out to Karns & Karns when I began to suspect that my other attorneys didn’t have the expertise to resolve a complicated case where the defendant, a massive organization, said I was at fault. I’m certainly glad I did. Bill and Mike treated me with respect, knew the law, and did exactly what was necessary to make the defendant accept responsibility for their bad acts. I recovered $1,000,000.00, and I have Karns & Karns to thank for that.

Ed B.

I can personally attest to the fact that Karns & Karns are perhaps the most responsive attorneys in California. To receive the sort of attention that I got from Mike and Bill is noteworthy.
